4、elopedinaccordancewiththeRegulationofthePeoplesRepublicofChinaontheAdministrationoftheRegistrationofMarketEntitiesandotherapplicablelawsandregulationsforthepurposesofregulatingtheorderofadministrationofenterpriseregistration,effectivelypreventing,investigating,andpunishingtheillegalactsoffalsifyinge

5、nterpriseregistration,acceleratingtheestablishmentofamarketorderbasedonintegrityandcompliance,effectivelysafeguardingtransactionsecurity,andcontinuouslyoptimizingthebusinessenvironment.Article2TheseProvisionsshallapplytotheprevention,investigation,andpunishmentoftheillegalactsoffalsifyingenterpriser

6、egistration.ForthepurposesoftheseProvisions,theuillegalactsoffalsifyingenterpriseregistrationnmeanstheillegalactsoffalselyusingthenameofanotherenterprisetoregisteritastheshareholderofalimitedliabilitycompany,asponsorofajoint-stocklimitedcompany,aninvestorofanunincorporatedenterpriselegalperson,orapa

7、rtnerofapartnershipenterprise,amongothers,byprovidingfalsematerialsorconcealingimportantfactsthroughotherfraudulentmeans.第二条本规定适用于对假 冒企业登记违法行为的防范和查 处。本规定所称假冒企业登记违法行 为，是指提交虚假材料或者采取 其他欺诈手段隐瞒重要事实，冒 用其他企业名义，将其登记为有 限责任公司股东、股份有限公司 发起人、非公司企业法人出资 人、合伙企业合伙人等的违法行 为。前款所称提交虚假材料或者采取 其他欺诈手段隐瞒重要事实，具 体情形包括：（一）伪造、变造

11、ionauthorityn)shallberesponsiblefortheprevention,investigation,andpunishmentoftheillegalactsoffalsifyingenterpriseregistrationwithinitsjurisdiction.Ifalocalpeoplesgovernmentatorabovethecountylevelprovidesotherwiseforthedutiesfortheinvestigationandhandlingoftheillegalactsoffalsifyingenterpriseregistr

12、ation,suchprovisionsshallprevail.第四条市场监督管理部门 应当会同相关部门构建防范和查 处假冒企业登记违法行为的沟通 协调机制，强化信息共享核验， 加强源头预防，推进全过程控 制，依法及时查处违法行为。Article4Marketregulatorydepartmentsshall,inconjunctionwiththerelevantdepartments,establishacommunicationandcoordinationmechanismfortheprevention,investigation,andpunishmentoftheillega

13、lactsoffalsifyingenterpriseregistration,strengtheninformationsharingandverification,strengthenpreventionfromthesource,promotewhole-processcontrol,andpromptlyinvestigateandpunishillegalactsinaccordancewiththelaw.第五条企业登记实行实名 制。申请人应当配合登记机关核 验身份信息。Article5Marketentitiesshallbesubjecttolegalnameregistrat

14、ion.Theapplicantshallcooperatewiththeregistrationauthorityintheverificationofidentityinformation.当事人为自然人的，应当配合登 记机关通过实名认证系统，采用 人脸识别等方式进行实名验证。Ifthepartyisanaturalperson,heorsheshallcooperatewiththeregistrationauthorityinconductinglegalnameauthenticationbyfacialrecognitionandothermethodsthroughthelega
