11、计人违约Designersdefault14.2 发包人违约Employersdefaults14.3 第三人造成的违约Defaultsduetothirdparties15 .争议的解决Settlementofdisputes部分章节示例如下：16 勘察设计要求Surveyrequirements16.1 一般要求Generalrequirements16.1.1 包人应当遵守法律和规范标准，不得以任何理由要求设计人违反法律和工程质量、安全标准进行勘察设计服务，降低工程质量。Theemployershallabidebythelaws,normsandstandards,andshallno

12、trequirethedesignertoconductsurveyservicesinviolationofIawszengineeringqualityandsafetystandardsforanyreason,reducethequalityoftheproject.16.1.2 计人应按照法律规定，以及国家、行业和地方的规颊口标准完成勘察设计工作，并应符合发包人要求。各项规范、标准和发包人要求之间如对同一内容的描述不一致时，应以描述更为严格的内容为准。Thedesignershallcompletethesurvey/designworkinaccordancewiththeIawz

13、aswellasthecodesandstandardsofStatezindustryandlocal,andshallmeettherequirementsoftheemployer.Ifanyinconsistencybetweenthespecifications,standardsandrequirementsoftheemployer,thestricterdescriptionofthecontentshallprevail.16.1.3 专用合同条款另有约定外，设计人完成勘察设计工作所应遵守的法律规定，以及国家、行业和地方的规范和标准，均应视为在基准日适用的版本。基准日之后，前

14、述版本发生重大变化，或者有新的法律,以及国家、行业和地方的规范和标准实施的，设计人应向发包人提出遵守新规定的建议。发包人应在收到建议后7天内发出是否遵守新规定的指示。发包人指示遵守新规定的，按照第11条约定执行。Unlessotherwisestipulatedintheparticularconditionshereof,thelegalrequirementsforthedesignertocompletethesurvey/designwork,aswellasStatezszindustryandlocalcodesandstandards,shallbedeemedtobeappli

15、cableonthebasedate.Ifzsubsequenttothebasedateztheaforementionedversionchangeoramendsignificantly,orifnewlawsandState,s,industryandlocalregulationsandstandardsbepromulgated,thedesignershouldadvisetheemployertocomplywiththenewregulations.Theemployershall,within7daysofreceiptoftherecommendation,giveinstructionsonwhetherornotcompliancewiththenewregulations.Iftheemployerinstructcompliancewiththenewregulations,itshallexecuteinaccordancewitharticle11.16.1.4 计人在勘察设计服务中选用的材料、设备，应注明其规格、型号、性能
