4、共和国国务院令（第755号）促进个体工商户发展条例已经2022年9月26日国务院第190次常务会议通过，现予公布，自2022年11月I日起施行。总理李克强2022年10月1日促进个体工商户发展条例第一条为了鼓励、支持和引导个体经济健康发展，维护个体工商户合法权益，稳定和扩大城乡就业，充lawfulrightsandinterestsofindividualindustrialandcommercialhouseholds,stabilizingandexpandingurbanandruralemployment,andmaximizingtheimportantroleofindividua

5、lindustrialandcommercialhouseholdsinnationaleconomicandsocialdevelopment.Article2WhereacitizenwithcapacityforoperationsisengagedinindustrialandcommercialoperationsintheterritoryofthePeoplesRepublicofChinaandlegallyregisteredasanindividualindustrialandcommercialhousehold,thisRegulationshallapply.Arti

6、cle3ThepromotionofthedevelopmentofindividualindustrialandcommercialhouseholdsshalladheretotheleadershipoftheCommunistPartyofChina(CPC),andmaximizetheguidingroleofCPCorganizationsinthedevelopmentofindividualindustrialandcommercialhouseholdsandthevanguardandexemplaryroleofCPCmembers.CPCorganizationsan

7、dCPCmembersamongindividualindustrialandcommercialhouseholdsshallcarryoutCPCactivitiesinaccordancewiththeprovisionsoftheCPCConstitution.Article4Theindividualsectoroftheeconomyisanimportantpartofthesocialistmarketeconomy,andindividualindustrialandcommercialhouseholdsareimportantmarketplayers,playingan

8、importantroleinprosperingtheeconomy,increasingemployment,promotingentrepreneurshipand分发挥个体工商户在国民经济和社会发展中的重要作用,制定本条例。第二条有经营能力的公民在中华人民共和国境内从事工商业经营，依法登记为个体工商户的，适用本条例。第三条促进个体工商户发展工作坚持中国共产党的领导，发挥党组织在个体工商户发展中的引领作用和党员先锋模范作用。个体工商户中的党组织和党员按照中国共产党章程的规定开展党的活动。第四条个体经济是社会主义市场经济的重要组成部分，个体工商户是重要的市场主体，在繁荣经济、增加就业、推动

10、ance,andlawfulregulation,andcreatefavorableconditionsforthesounddevelopmentofindividualindustrialandcommercialhouseholds.Article5Thestateshallimplementtheprinciplesofequalmarketaccessandfairtreatmentforindividualindustrialandcommercialhouseholds.Article6Anindividualindustrialandcommercialhouseholdma

11、ybeoperatedeitherbyanindividualorbyafamily.Thepropertyrights,operatingautonomy,andotherlawfulrightsandinterestsoftheindividualindustrialandcommercialhouseholdshallbeprotectedbylaw,andmaynotbeharmedorillegallyinterferedwithbyanyentityorindividual.Article7TheStateCouncilshallestablishaninter-ministeri

12、aljointmeetingonthepromotionofthedevelopmentofindividualindustrialandcommercialhouseholds,researchandadvancetheimplementationofmajorpoliciesandmeasurestopromotethedevelopmentofindividualindustrialandcommercialhouseholds,andoverallcoordinatemajormattersinpromotingthedevelopmentofindividualindustrial国

13、家持续深化简政放权、放管结合、优化服务改革，优化营商环境，积极扶持、加强引导、依法规范，为个体工商户健康发展创造有利条件。第五条国家对个体工商户实行市场平等准入、公平待遇的原则。第六条个体工商户可以个人经营，也可以家庭经营。个体工商户的财产权、经营自主权等合法权益受法律保护，任何单位和个人不得侵害或者非法干预。第七条国务院建立促进个体工商户发展部际联席会议制度，研究并推进实施促进个体工商户发展的重大政策措施，统筹协调促进个体工商户发展工作中的重大事项。andcommercialhouseholds.国务院市场监督管理部门会同有关部门加强对促进个体工商户发展工作的宏观指导、综合协调和监督检查。第

14、/1条 国务院发展改革、财政、人力资源社会保 障、住房城乡建设、商务、金融、税务、市场监督管理等 有关部门在各自职责范围内研究制定税费支持、创业扶 持、职业技能培训、社会保障、金融服务、登记注册、权 益保护等方面的政策措施，做好促进个体工商户发展工 作。第九条县级以上地方人民政府应当将促进个体工商户发展纳入本级国民经济和社会发展规划，结合本行政 区域个体工商户发展情况制定具体措施并组织实施，为个 体工商户发展提供支持。第十条国家加强个体工商户发展状况监测分析，定期开展抽样调查、监测统计和活跃度分析，强化个体工 商户发展信息的归集、共享和运用。Themarketregulator/departm
