5、ondtimeinaccordancewithOrderNo.311ofthePeoplesGovernmentofBeijingMunicipalityonNovember15,2023)Article 1 TheseProvisionsaredevelopedforthepurposesofimplementingtheAdministrativePenaltyLawofthePeoplesRepublicofChina.Article 2 TheimpositionofadministrativepenaltiesbyadministrativeorgansofthisMunicipal

6、ityatalllevelsshallcomplywiththeseProvisions.根据2023年11月15日北京 市人民政府第311号令第二次 修改）第一条为贯彻实施中 华人民共和国行政处罚法， 制定本规定。第二条本市各级行政机 关实施行政处罚，应当遵守本 规定。法律、法规授权的具有管理公 共事务职能的组织在法定授权 范围内实施行政处罚，以及依 法受委托的组织在委托范围内 实施行政处罚，适用本规定的 有关规定。If administrative penalty otherwise provided for regulation, departmental rules of this M

8、sauthorizedbylawsaswellastheimpositionofadministrativepenaltiesbylegallyentrustedorganizationswithinthescopeoftheirauthorization.第三条 市人民政府可以 决定一个行政机关行使有关行 政机关的行政处罚权；可以决 定将基层管理迫切需要的区人 民政府部门的行政处罚权交由 能够有效承接的乡镇人民政 府、街道办事处行使，并定期 组织评估。决定应当公布。Article 3 Themunicipalpeoplesgovernmentmaydecideonanadministrati

11、tmentalrule.对当事人的同一违法行为，两 个以上行政机关都有管辖权 的，由最先立案的行政机关管 辖。对管辖发生争议的，应当协商 解决，协商不成的，报请共同 的上一级行政机关指定管辖； 也可以直接由共同的上一级行 政机关指定管辖。Iftwoormoreadministrativeorganshavejurisdictionoverthesameillegalactcommittedbyaparty,theadministrativeorganthatfirstdocketsthecaseshallhavejurisdiction.行政机关实施行政处罚过程 中，发现属于其他机关管辖的 违

12、法行为，应当将有关线索和 证据及时移送具有管辖权的机 关处理。Anydisputeoverjurisdictionshallberesolvedthroughnegotiation,andifnegotiationfails,arequestshallbesubmittedtothecommonadministrativeorganatthenexthigherlevelfordesignationofjurisdiction;orthecommonadministrativeorganatthenexthigherlevelmaydirectlydesignatejurisdiction.I

13、f,inthecourseofexecutinganadministrativepenalty,anadministrativeorgandiscoversanyillegalactunderthejurisdictionofanotherorgan,itshallpromptlytransferrelevantcluesandevidencetotheorganthathasjurisdictionforhandling.第五条 行政机关因实施 行政处罚的需要，可以向有关 行政机关提出协助请求。除紧 急情况外，行政机关应当书面 提出协助请求。书面协助请求 应当载明请求协助的事由、事 项、协助

14、方式,、协助结果反馈Article5Whereitisnecessaryforanadministrativeorgantoenforceanadministrativepenalty,itmayrequestassistancefromtherelevantadministrativeorgan.Exceptforemergencies,theadministrativeorganshallsubmitawrittenrequestforassistance.ThewrittenrequestfnraccictonnoChallindintothrocnn期限和方式以及其他需要载明的事项，并
