3、总则Chapter I GeneralProvisions第一条为了规范使用民用无人 驾驶航空器（以下简称“无人驾驶航 空器”）从事经营性飞行活动，加强 市场监管，促进无人驾驶航空器产业 安全、有序、健康发展，依据民航 法及无人驾驶航空器管理的有关规 定，制定本办法。Article1Forthepurposesofregulatingtheuseofcivilunmannedaerialvehicles(uUAVn)tocarryoutoperationalflightactivities,strengtheningmarketsupervision,andpromotingthesafe,o

4、rderlyandsounddevelopmentoftheUAVindustry,theseMeasuresaredevelopedinaccordancewiththeCivilAviationLawandtherelevantprovisionsontheadministrationofUAV.Article2Thesemeasuresshallbeapplied第二条本办法适用于在中华人toaerialspraying（sprinkling）,民共和国境内（港澳台地区除外）使aerophotography,aerialphotography,show用最大空机重量为250克以上（含fl

5、ightsandotheroperationalandUAVpilotstrainingactivitiescarriedoutwithintheterritoryofthePeoplesRepublicofChina(excludingHongKong,MacaoandTaiwan)withUAVsofmaximumemptyweightof250gramsormore.Thesemeasuresshallnotbeappliedtothepassenger-andcargocarryingoperationalflightactivitiescarriedoutwithUAVs.Artic

6、le3AnoperationpermitshallbeobtainedforcarryingouttheoperationalflightactivitiessetoutinArticle2oftheseMeasureswithUAVs,andnooperationalflightactivitiesshallbecarriedoutwithoutanoperationpermit.Article4TheCivilAviationAdministrationofChina(uCAACn)shallimplementunifiedsupervisionandadministrationofthe

7、operationpermitsofUAVs.TheCAACregionaladministrationsshallberesponsiblefortheissuance,supervisionandadministrationofoperationpermitsofUAVswithintheirjurisdictions.Chapter II ConditionsandProceduresfortheApplicationforPermitsArticle 5 AnapplicantforanoperationpermitofUAVsshallmeetthefollowingbasiccon

8、ditions:250克）的无人驾驶航空器开展航空 喷洒（撒）、航空摄影、空中拍照、 表演飞行等作业类和无人机驾驶员培 训类的经营活动。无人驾驶航空器开 展载客类和载货类经营性飞行活动不 适用本办法。第三条使用无人驾驶航空器开 展本办法第二条所列的经营性飞行活 动应当取得经营许可证，未取得经营 许可证的，不得开展经营性飞行活 动。第四条中国民用航空局（以下 简称民航局）对无人驾驶航空器经营 许可证实施统一监督管理。中国民用 航空地区管理局（以下简称民航地区 管理局）负责实施辖区内的无人驾驶 航空器经营许可证颁发及监管管理工 作。第二章许可证申请条件及程序第五条取得无人驾驶航空器经 营许可证，应

9、当具备下列基本条件：（一）从事经营活动的主体应当为企 业法人，法定代表人为中国籍公民；(1) Theentityengaginginbusinessactivitiesshallbeanenterpriselegalperson,andthelegalrepresentativeshallbeaChinesecitizen.(2) TheenterpriseshallhaveoneUAVataminimum,andundergotheformalitiesofrealnameregistrationintheureal-nameregistrationinformationsystemofth

10、eCAACforcivilUAVs.w(3) Theenterprisehasthetrainingabilityrecognizedbythecompetentdepartmentoftheindustryoraninstitutionauthorizedthereby(thisparagraphshallonlybeappliedtotrainingactivities).(4) Ithaspurchasedthird-partygroundliabilityinsuranceforUAVs.Article 6 Underoneofthefollowingcircumstances,noa

11、pplicationforanoperationpermitofUAVsshallbeaccepted:(1) Anapplicantre-filesanapplicationwithinoneyear,aftertheapplicationisrejectedforprovisionoffalsematerials.(2) Anapplicantre-filesanapplicationwithinthreeyear,aftertheoperationpermitobtainedbysuchimpropermeansasfraudandbriberyisrevoked.(3) Anenter

12、priseisincludedintheublacklisofcreditmanagementinthecivilaviationindustryduetoseriouslydishonestacts.(4) Othercircumstancesunderwhichapplicationsshallnotbeacceptedasprescribedinlawsandregulations.（二）企业应至少拥有一架无人驾驶 航空器，且以该企业名称在中国民用 航空局”民用无人驾驶航空器实名登 记信息系统”中完成实名登记；（三）具有行业主管部门或经其授权 机构认可的培训能力（此款仅适用从 事培训类经

13、营活动）；（四）投保无人驾驶航空器地面第三 人责任险。第六条具有下列情形之一的， 不予受理无人驾驶航空器经营许可证 申请：（一）申请人提供虚假材料被驳回, 一年内再次申请的；（二）申请人以欺骗、贿赂等不正当 手段取得经营许可证后被撤销，三年 内再次申请的；（三）因严重失信行为被列入民航行 业信用管理”黑名单”的企业；（四）法律、法规规定不予受理的其 他情形。第七条 申请人应当通过”民用Article 7 Anapplicantshallapplyforan无人驾驶航空器经营许可证管理系统 ”（https： / / u a s . g a . c a a c . gov. c n ）在线 申请无

14、人驾驶航空器经营许可证，申 请人须在线填报以下信息，并确保申 请材料及信息真实、合法、有效：operationpermitofUAVsonlinethroughtheuUAVsOperationPermitManagementSystem(hppts).Anapplicantmustenterthefollowinginformationonlineandensurethattheapplicationmaterialsandinformationareauthentic,legalandvalid:(1) thebasicinformationoftheenterpriselegalpers

15、on;(2) thereal-nameregistrationnumbersoftheUAVs;(3) thecertificationnumberoftheUAVdrivertraininginstitution(thisparagraphisonlyappliedtotrainingbusinessactivities);（一）企业法人基本信息;（二）无人驾驶航空器实名登记号;（三）无人机驾驶员培训机构认证编号（此款仅适用于培训类经营活动）；（四）投保地面第三人责任险承诺;(4) theguaranteeforpurchasingthird-partygroundliabilityinsu

16、rance;and（五）企业拟开展的无人驾驶航空器 经营项目。(5) theUAVbusinessprojectstobecarriedoutbytheenterprise.第八条民航地区管理局应当自 申请人在线成功提交申请材料之日起 二十日内作出是否准予许可的决定。 准予许可的，申请人可在线获取电子 经营许可证，不予许可的，申请人可 在线查询原因。Article8TheCAACregionaladministrationshall,within20daysofthedatewhenanapplicantsuccessfullysubmitstheapplicationmaterialsonline,makeadecisionofwhet
