5、tsforDishonestActsWhichViolatetheSystemofMarketAccessuponCommitment(Adoptedatthe7thsessionoftheStandingCommitteeoftheSeventhPeoplesCongressofHainanProvinceonNovember24,2023)Article1ForthepurposesofpreventingandpunishingseriouslydishonestactsthatviolatethesystemofmarketaccessuponcommitmentoftheHainan

6、FreeTradePort,theseProvisionsaredevelopedinaccordancewiththeHainanFreeTradePortLawofthePeoplesRepublicofChina,theSocialCreditRegulationoftheHainanFreeTradePortandotherlawsandregulationsandrelevantprovisionsissuedbythestateandinlightoftheactualcircumstancesoftheHainanFreeTradePort.Article2Relevantdep

7、artmentsofthepeoplesgovernmentsatorabovethecountylevelshall,accordingtotheirrespectivefunctions,conductcreditregulationofthebusinessesgovernedbythesystemofmarketaccessuponcommitment,andimposecredit-relatedpunishmentsfortheirseriouslydishonestactsinaccordancewiththelaw.海南自由贸易港违反市场准入承 诺即入制失信惩戒若干规定（202

8、3年11月24日海南省第 七届人民代表大会常务委员会第 七次会议通过）第一条为了预防和惩戒违 反海南自由贸易港市场准入承诺 即入制的严重失信行为，根据 中华人民共和国海南自由贸易 港法海南自由贸易港社会信 用条例等法律、法规和国家有 关规定，结合海南自由贸易港实 际，制定本规定。第二条县级以上人民政府 有关部门应当按照各自职责对适 用市场准入承诺即入制的经营者 实施信用监管，依法对其严重失 信行为予以信用惩戒。第三条经营者违反市场准 入承诺即入制管理规定，有下列 情形之一的，由县级以上人民政 府有关部门将其列入市场准入承 诺即入制严重失信主体名单（以 下简称严重失信主体名单）：Article3

9、Ifabusinessfallsunderanyofthefollowingcircumstancesinviolationoftheadministrativeprovisionsonthesystemofmarketaccessuponcommitment,therelevantdepartmentsofthepeople,sgovernmentatorabovethecountylevelshallincludeitorhiminthelistofseriouslydishonestpartiesthatviolatethesystemofmarketaccessuponcommitme

10、nt(hereinafterreferredtoastheuIistofseriouslydishonestparties).(1) Itorhereceivesanyadministrativepunishmentforconductinginvestmentandbusinessactivitieswithoutundergoingtherecordationformalitiesorhavingtherecordationformalitiescompletedbasedonfalsematerialsandrefusingtotakecorrectiveactionafterbeing

11、orderedtodosobytherelevantdepartment.(2) Itorhereceivesanyadministrativepunishmentforconductinginvestmentandbusinessactivitieswithoutsubmittingmaterialsduringaspecifiedperiodorbysubmittingmaterialsthatfailtomeettherequirementsandrefusingtotakecorrectiveactionafterbeingorderedtodosobytherelevantdepar

12、tment.(3) Itorheotherwiseviolatestheadministrativeprovisionsonthesystemofmarketaccessuponcommitment,andshallbeincludedinthelistofseriouslydishonestpartiesinaccordancewithlaws,regulationsandrelevantprovisionsissuedbythestate.Article4Therelevantdepartmentofapeoplesgovernmentatorabovethecountylevelshal

13、l,within20workingdaysfromthedatewhenitmakesadecisiontoincludearelevantbusinessinthelistofseriouslydishonestparties,publicizethelistofseriouslydishonestpartiesthroughCreditChina(Hainan)andtheNationalEnterpriseCreditInformationPublicitySystem(Hainan).（一）未办理备案或者提交虚假 材料办理备案开展投资经营活 动，经有关部门责令改正而拒不 改正，受到行政

14、处罚的；（二）办理备案后，在约定的期 限内未提交材料或者提交的材料 不符合要求，开展投资经营活 动，经有关部门责令改正而拒不 改正，受到行政处罚的；（三）其他违反市场准入承诺即 入制管理规定，依照法律、法规 和国家有关规定应当列入严重失 信主体名单的。第四条 县级以上人民政府 有关部门应当自作出列入严重失 信主体名单决定之日起二十个工 作日内，将严重失信主体名单通 过信用中国（海南）、国家企业 信用信息公示系统（海南）向社 会公示。第五条 县级以上人民政府 有关部门对列入严重失信主体名 单的经营者实施以下失信惩戒措 施：Article5Relevantdepartmentsofthepeopl

15、esgovernmentsatorabovethecountylevelshallimplementthefollowingpunishmentmeasuresagainstthebusinessesthatareincludedinthe(1) Prohibitingthebusinessesfromengagingthebusinessactivitiesinthefieldsinwhichtheyviolatethesystemofmarketaccessuponcommitment.(2) 1.istingthebusinessesasobjectsunderpriorityregul

16、ation,strengtheningroutineregulationandinspections,increasingtheproportionofrandominspectionsandthefrequencyofinspections,andconductingstrictregulationinaccordancewiththelaw.(3) Notapplyingfacilitativemeasuressuchasnotificationandcommitmentsysteminpublicadministrationandpublicservices.(4) Deductingcreditscoresanddegradingcreditratingsduringpublicresourcetrading.(5) Restri
