5、accordancewiththeAtmosphericPollutionPreventionandControlLawofthePeoplesRepublicofChinaandotherlawsandadministrativeregulationsforpurposeofregulatingtheemissionsrecallsofmotorvehicles,protectingandimprovingtheenvironment,andsafeguardinghumanhealth.第一条为了规范机动车排放召回工作，保护和改善环境，保障人体健康，根据中华人民共和国大气污染防治法等法律、

6、行政法规，制定本规定。Article2TheseProvisionsshallapplytotheemissionsrecallsofmotorvehiclesandthesupervisionandadministrationthereofwithintheterritoryofthePeoplesRepublicofChina.第二条在中华人民共和国境内开展机动车排放召回及其监督管理，适用本规定。Article3ForthepurposeoftheseProvisions,emissionsrecallmeansthetakingofmeasuresbyamotorvehiclemanuf

7、acturertoeliminatemotorvehicleemissionshazards.第三条本规定所称排放召回，是指机动车生产者采取措施消除机动车排放危害的活动。ForthepurposeoftheseProvisions,“emissionshazardsmeansasituationthatdoesnotconformtothenationalstandardsforthedischargeofairpollutantscommonlyexistinginasamebatch,model,orcategoryofmotorvehiclesduetodesignorproductio

8、ndefectsornon-compliancewiththespecifiedenvironmentalprotectiondurabilityrequirements.本规定所称排放危害，是指因设计、生产缺陷或者不符合规定的环境保护耐久性要求，致使同一批次、型号或者类别的机动车中普遍存在的不符合大气污染物排放国家标准的情形。Article4Whereamotorvehiclehasemissionshazards,itsmanufacturershallmakearecall.第四条机动车存在排放危害的，其生产者应当实施召回。进口机动车的进口商，视为本 规定所称的机动车生产者。Theimp

9、orterofanimportedmotorvehicleshallbedeemedasthemanufacturerofthemotorvehicleasmentionedintheseProvisions.第五条国家市场监督管 理总局会同生态环境部负责机 动车排放召回监督管理工作。Article5TheStateAdministrationforMarketRegulation,togetherwiththeMinistryofEcologyandEnvironment,shallberesponsibleforthesupervisionandadministrationofmotorv

10、ehicleemissionsrecalls.国家市场监督管理总局和生态 环境部可以根据工作需要，委 托各自的下一级行政机关承担 本行政区域内机动车排放召回 监督管理有关工作。TheStateAdministrationforMarketRegulationandtheMinistryofEcologyandEnvironmentmay,asneededinwork,authorizetheirrespectiveadministrativeauthoritiesatthenextlowerleveltoundertakethesupervisionandadministrationofmot

11、orvehicleemissionsrecallswithintheirrespectiveadministrativeareas.国家市场监督管理总局和生态 环境部可以委托相关技术机构 承担排放召回的技术工作。TheStateAdministrationforMarketRegulationandtheMinistryofEcologyandEnvironmentmayauthorizerelevanttechnicalinstitutionstoundertakethetechnicalworkofemissionsrecalls.第六条国家市场监督管 理总局负责建立机动车排放召 回信息系

12、统和监督管理平台， 与生态环境部建立信息共享机 制，开展信息会商。Article6TheStateAdministrationforMarketRegulationshallberesponsibleforestablishinganinformationsystemandsupervisionandmanagementplatformformotorvehicleemissionsrecalls.Itshall,alongwiththeMinistryofEcologyandEnvironment,establishaninformation-sharingmechanismtocarryo

13、utinformationconsultation.第七条 生态环境部负责 收集和分析机动车排放检验检 测信息、污染控制技术信息和 排放投诉举报信息。Article7TheMinistryofEcologyandEnvironmentshallberesponsibleforthecollectionandanalysisofinformationonmotorvehicleemissionsinspectionandtesting,pollutioncontroltechnology,andemissionscomplaintsandtip-offs.设区的市级以上地方生态环境Theloca

14、lecologyandenvironmentauthorityatorabovethelevelofadistrictedcityshallcollectandanalyze information on motor vehicle emissions inspection and testing, pollution control technology and emissions complaints and tip-offs, and escalate the information that may relate to emissions hazards to the Ministry

15、 of Ecology and Environment.部门应当收集和分析机动车排 放检验检测信息、污染控制技 术信息和排放投诉举报信息， 并将可能与排放危害相关的信 息逐级上报至生态环境部。Article 8 The manufacturer of a motor vehicle shall record and keep information on the design, manufacture, emissions inspection and testing of the motor vehicle as well as information on the owner of the motor vehicle sold for the first time, and such information shall be kept for not less than ten years.Article 9 A motor vehicle manufacturer shall, in a timely manner, report the following information through the Information System for Motor Vehicle Emissions Recalls:第八条机动车生产者应 当记录并保存机动车设计、制
