3、法和有关法律法规，经甲、乙双方协商一致，就甲方委托乙方测绘房屋建筑面积事宜，签订本合同。InaccordancewiththeCivilCodeofthePeoplesRepublicofChina,theLawofthePeoplesRepublicofChinaonSurveying&Mapping,theMeasuresfortheAdministrationofPropertySurveyingandMappingandtherelevantlawsandregulations,thepartieshereto,throughconsensus,concludethiscontract

4、onPartyA,scommissionforPartyB,sSurveying&Mappingofhefloorareaofthehouse.第一条测绘项目ArticleIProjectofSurveyandMapping测绘项目内容：房屋建筑面积测绘Contentofthesurveyingandmappingproject:Surveyingandmappingofthebuildingareaofhouses测绘项目名称：Projectnameofthesurveyingandmapping:测绘项目地址：Projectaddressofthesurveyingandmapping:第

5、四条测绘项目执行技术标准Article4Technicalstandardofsurveyingandmappingproject房产测量规范(GBT17986.1-2000)、房产图图式(GB/T17986.2-2000)、房屋建筑面积测算实施细则等。除上述标准外，由房地产行政主管部门依据上述标准制定的相关规定也可作为依据(与上述标准抵触的规定除外)。SpecificationforHousePropertyMeasurement(GBT17986.1-2000),MapFormatofHouseProperty(GBT17986.2-2000),ImplementingRulesforth

6、eMeasurementofHouseFloorArea,etc.Inadditiontotheabovestandards,relevantregulationsformulatedbytherealestateadministrativeauthoritiesonthebasisoftheabovestandardsmayalsobeusedasabasis(exceptfortheregulationsthatareinconflictwiththeabovestandards).第六条测绘期限Article6PeriodofSurveyandMapping双方约定本测绘项目工期开始日为

7、年一月日，工期日历天,乙方应于年_月一日前向甲方交付房屋建筑面积测绘成果书，甲方收到乙方交付的成果书后日内出具签收凭证。Partiesheretoagreethecommencementdateoftheworkingperiodofthissurveyandmappingprojectshallcommenceonthedateofdaymonthyearwiththeworkingdaysofcalendardays.PartyBshalldelivertheResultsofHouseFloorAreaSurveyingandMappingtoPartyApriortothedateof

8、daymonthyearandPartyAshallissueacertificateofsigningacceptancewithindaysuponreceiptoftheResultsdeliveredbyPartyB.第七条甲方的义务Article7PartyA,Obligations(一)甲方应于工期开始日前，向乙方提供与测绘项目有关的下列资料(在口内打V选择)，如甲方提供的资料不全或不符合测绘要求，甲方应按乙方要求于一日内补齐或改正：(1)PartyAshall,priortothecommencementdateoftheworkperiod,providePartyBwitht

9、hefollowinginformationrelatedtothesurveyandmappingproject(tickintoselect).WheretheinformationprovidedbyPartyAisincompleteorfailstomeettherequirementsofsurveyandmapping,PartyAshall,withindays,makesupplementandcorrectionoftheinformationasrequiredbyPartyB:第十条乙方违约责任Article10PartyBsLiabilityforBreach(一)合

10、同签订后，乙方无正当理由单方解除合同或擅自中途停止测绘,如未造成损失，按合同预算总价款的百分之一向甲方支付违约金；如造成甲方损失的，乙方应予以赔偿。(1)PartyBwhich,subsequenttoconclusionofthecontract,unilaterallycancelsthecontractWithoutjustifiablereasonsorstopssurveyandmappingarbitrarily,PartyBshallpayliquidateddamagestoPartyAattherateofpercentofthetotalpriceofthebudgetof

11、thecontractifnolossiscaused;however,wherelossiscausedtoPartyA,PartyBshallpaycompensation.(二)未经甲方同意，乙方擅自将测绘项目部分或全部转委托给第三方测绘的，甲方可终止合同，如未造成损失，按合同预算总价款的百分之一向甲方支付违约金；如造成甲方损失的，乙方应予以赔偿。(2)WherePartyBsubcontractswithoutPartyAsconsentpartorallofthesurveyandmappingprojecttoathirdparty,PartyAmayterminatethecon

12、tract,andifnolossiscaused,PartyBshallpayliquidateddamagestoPartyAattherateofpercentofthetotalpriceofthebudgetofthecontract;andPartyBshallcompensatePartyAforthelosscausedbyit.第十一条争议解决方式Article11DisputeSettlement双方在合同履行过程中发生纠纷的，可由双方协商解决，若达不成协议的，双方同意就本合同产生的纠纷按下列第种方式解决：Anydisputearisingbetweentheparties

13、inthecourseoftheperformanceofthecontractmayberesolvedbymutualagreement,andifnoagreementisreached,thepartiesagreethatdisputesarisingoutofthiscontractshallberesolvedinthefollowingmanner:(1)向一仲裁委员会申请仲裁；(1)ToeffectapplicationforarbitrationtotheArbitrationCommittee;(2)向一人民法院起诉。(2)TobringalawsuittothePeoplesCourt.
