1、工程合同中的履约担保条款中英文对照版工程合同中的履约担保条款ARTICLEOFPERFORMANCESECURITY发包人需要承包人提供履约担保的，由合同当事人在专用合同条款中约定履约担保的方式、金额及期限等。履约担保可以采用银行保函或担保公司担保等形式，具体由合同当事人在专用合同条款中约定。Wheretheemployerrequirethecontractorprovideperformanceguarantee,themanner,amount,termandothersofguaranteewillbe,betweenpartiesthereto,agreedinparticularc

5、ContractorshalldeliverthePerformanceSecuritytotheEmployerwithin28daysafterbothPartieshavesignedtheContractAgreementThePerformanceSecurityshallbeissuedbyanentityandfromwithinacountry(orOtherjuriscliction)approvedbytheEmployer,andshallbeintheformannexedtotheParticularConditionsorinanotherformapprovedb

6、ytheEmployer.承包商应确保履约担保直到其完成工程的施工、竣工和修补完任1可缺陷前持续有效和可执行。如果在履约担保的条款中规定了其期满日期，而承包商在该期满日期28天前尚无权拿到履约证书，承包商应将履约担保的有效期延至工程竣工和修补完任何缺陷时为止。TheContractorshallensurethatthePerformanceSecurityisvalidandenforceableuntiltheContractorhasexecutedandcompletedtheWorksandremediedanydefects.IfthetermsofthePerformanceSe

7、curityspecifyitsexpirydate,andtheContractorhasnotbecomeentitledtoreceivethePerformanceCertificatebythedate28dayspriortotheexpirydate,theContractorshallextendthevalidityofthePerformanceSecurityuntiltheWorkshavebeencompletedandanydefectshavebeenremedied.除出现以下情况雇主根据合同有权获得的金额外，雇主不应根据履约担保提出索赔：TheEmployer

8、shallnotmakeaclaimunderthePerformanceSecurity,exceptforamountstowhichtheEmployerisentitledundertheContractintheeventof:承包商未能按前一段所述延长履约担保的有效期，这时雇主可以索赔履约担保的全部金额；FailurebytheContractortoextendthevalidityofthePerformanceSecurityasdescribedintheprecedingparagraph,inwhicheventtheEmployermayclaimthefullamo

10、eiptofLetterOfAcceptance,inthesumstatedintheAppendixtoTender.WhenprovidingsuchsecuritytotheEmployer,theContractorshallnotifytheEngineerofsodoing.SuchsecurityshallbeintheformannexedtotheseConditionsorinsuchotherformasmaybeagreedbetweentheEmployerandtheContractor.Theinstitutionprovidingsuchsecuritysha

11、llbesubjecttotheapprovaloftheEmployer.ThecostofcomplyingwiththerequirementsoftheClauseshallbebornebytheContractor,unlesstheContractotherwiseprovides.除雇主同意之外，承包商不应做出任何有损雇主利益的认可，直至承包商按雇主的要求提交雇主此类合适的担保。该担保的数额应为雇主可能负责的且本款中的保障所适用的补偿费、损害赔偿费、手续费及诉讼费的估算额。ExcepttotheextentthattheEmployeragreesotherwise,theCo

12、ntractorshallnotmakeanyadmissionwhichmightbeprejudicialtotheEmployer,untiltheContractorhasgiventheEmployersuchreasonablesecurityastheEmployermayrequire.Thesecurityshallbeforanamountwhichisanassessmentofthecompensation,damages,chargesandcostsforwhichtheEmployermaybecomeliable,andtowhichtheindemnityun

13、derthisSub-Clauseapplies.发包人已经获得银行签发的不可撤销及无条件履约保函，担保金额为人民币壹佰柒拾陆万元。TheemployerhasobtainedanirrevocableandunconditionalperformanceguaranteeissuedbyamajorChineseBank,underwhichtheguaranteedvalueisRMB承包人向发包人提供担保金额为人民币_元的银行履约保函，按合同约定履行自己的各项义务。TheContractorshallprovidetheBankPerformanceGuaranteewithaguara
