3、vantlawsandregulations,partyAandPartyBthroughconsultationenterintothisContractforthesaleofautomobilesonthebasisofequality,voluntaryagreementandconsensus.第三条付款方式Article3Modeofpayment乙方选择下述第一种方式付款，并按该方式所定时间如期足额将车款支付给甲方。PartyBchoosesthefollowingmethodofpaymentandeffectspaymentinfull,toPartyA,ofthevehic

Directpaymentmethod:签订本合同后乙方应于年一月一日前向甲方付清合同价款，计人民币一元(大写一元)。PartyBshall,uponconclusionofthisContract,effectpaymentofthecontractpricetoPartyApriorto_day_monthyear,fortheamountofRMBYuan(inwordYuan).2 .汽车消费贷款方式：2. Vehicleconsumerloanoptions.(3)乙方如需甲方提供贷款事项的相关
5、服务，由甲乙双方另行签订贷款购车事项委托协议。(3)WherePartyBneedsPartyAtoproviderelevantservicesfortheloanmatters,PartyAandPartyBshallenterintoaseparatetheEntrustedAgreementofLoanforCarPurchase.第四条质量Article4Quality1.甲方向乙方出售的车辆，应当不存在危及人身、财产安全的不合理的危险，符合保障人体健康和人身、财产安全的国家标准、行业标准,具备产品应当具备的使用性能等，符合注明采用的产品标准，符合以产品、实物样品等方式表明的质量状况
6、，符合出厂检验标准，符合安全驾驶和说明书载明的使用要求，双方另有约定的情形除外。1. ThevehiclesoldbyPartyAtoPartyBshallbefreefromunreasonabledangerwhichendangersthesafetyofpersonsandproperty,complywiththeState,sstandardsandindustrystandardsfortheprotectionofhumanhealthandthesafetyofpersonsandproperty,havetheperformancewhichtheproductshould
7、haveforusezetc.,complywiththeproductstandardsindicatedasadopted,complywiththequalityconditionindicatedbytheproduct,physicalsamples,etc.,complywiththefactoryinspectionstandards,andcomplywithsafedrivingandmanual,therequirementsforuseassetoutinthemanual,unlessotherwiseagreedbytheparties.2. 甲方向乙方出售的车辆，必
8、须是经国家有关部门公布、备案的汽车产品公告上的产品或合法进口的产品，并符合公安交通管理部门关于机动车辆的注册登记条件。3. ThevehiclessoldbyPartyAtoPartyBshouldbetheproductsonthevehicleproductbulletinpublishedandfiledbytheState,srelevantdepartmentsorlegallyimportedproducts,andmeettheregistrationconditionsofthepublicsecuritytrafficmanagementauthorityonmotorveh
9、icles.3.甲方保证向乙方出售的车辆，在交付前已作必要的检查和清洁，并按生产厂的技术要求完成交车前检查（PDI/PDS）并排除已发现的汽车故障或瑕疵。4. ThePartyAwarrantthatthevehiclesoldtoPartyBzpriortodelivery,hasbeeninspectedandcleanedasnecessaryandthepre-deliveryinspection(PDI/PDS)hasbeencompletedinaccordancewiththetechnicalrequirementsofthemanufacturerandanyfaultsor
10、defectsfoundinthevehiclehavebeenremoved.第五条交车时间与地点、交付及验收方式Article5.Timeandplaceofdelivery,modeofdeliveryandacceptance4. 交车时里程表记录小于：(1)100公里口(2)一公里(注：以上里程表记录不包含委托上牌服务发生的公里数。)5. Theodometerrecorduponvehicledeliveryislessthan:(1)100km(2)km(Note:Theaboveodometerrecordsdonotincludethekilometersincommissi
11、oningthelicensingservice.)5.甲方在向乙方交付车辆时须同时提供：6. Thefollowingdocumentsshall,atthetimeofdeliveryofthevehicle,beprovidedbythePartyAtothePartyB.(1)销售发票。Q)Salesinvoice.(2)(国产车)车辆合格证/(进口车)海关进口证明、商品检验单及车辆一致性证书。(2) (Domesticvehicles)Vehicle*sCertificateofConformity/(Importedvehicles)CustomsImportCertificate
12、,CommodityInspectionCertificateandVehicleConformityCertificate.(3)三包凭证(家用汽车)、维修保养手册、修理网点信息。(3) TheCertificateforthree-guaranteeservice(fordomesticcars),maintenancemanual,repairoutletinformation.(4)车辆使用说明书或用户使用手册。(4) Vehicleinstructionmanualorusermanual.(5) (5)随车工具及备件清单。(6) 1.istoftoolsandsparepartsa
13、ccompanyingthevehicle.(7) 辆交接时应当场验收，乙方应对所购车辆外观、内饰、配置、随车物件和使用功能等进行认真查验，如有异议，应当场向甲方提出，由甲方按照双方协商的方式处理。6.ThehandoverofthevehicleshouldbesubjecttotheacceptanceonthespotPartyBshallcarefullychecktheappearance,interiordecoration,configuration,accompanyingobjectsandusefunctionsofthepurchasedvehicle,etc.andit
14、sanyobjectionshall,onthespotzbeputforwardtoPartyAwhichshallhandleitpursuanttothemethodagreedbytheparties.2. 乙方不能按时支付车款的，自延期之日起至实际付款日止，每日按逾期应付款的一%o向甲方支付违约金，最高不超过合同总价款的%o延期付款超过1个月(也可双方协商期限)的，甲方有权解除合同。3. PartyBshallbechargedtheoverdueamountatdailyrateof%foritsfailureofpaymentforthevehicleontimefromthed
15、ateofextensionuntiltheactualdateofpayment.TheliquidateddamagespaidtoPartyAshallnotexceed%ofthetotalcontractprice.Wherepaymentisdelayedformorethanonemonth(oramutuallyagreedperiod),PartyAhastherighttoterminatethecontract.3.如果乙方不按时验收接车，且经甲方通知后超过1个月(也可双方协商期限)仍未验收接车的，甲方有权解除合同。4. WherePartyBdoesnotacceptt
16、hevehicleontimeandfailstodosoformorethanonemonthuponnotificationbyPartyA(orbymutualagreement),PartyAhastherighttoterminatethecontract.5. 甲、乙双方因不可抗力不能履行本合同的，根据不可抗力的影响部分或者全部免除责任，但法律另有规定的除外。甲、乙双方迟延履行后发生不可抗力的，不能免除责任。6.
