4、制：(a) areengineersorotherprofessionals,qualified,experiencedandcompetentinthedisciplinesofthedesignforwhichtheyareresponsible;工程师或其他专业人员、在设计中具有资格、经验和能力的负责人员(b) complywiththecriteria(ifany)statedintheEmployersRequirements;and符合雇主要求中规定的标准(如果有);和(c) arequalifiedandentitledunderapplicableLawstodesignthe

5、Works.根据适用法律有资格并有权设计工程。UnlessotherwisestatedintheEmployersRequirements,theContractorshallsubmittotheEngineerforconsentthename,address,detailedparticularsandrelevantexperienceofeachproposeddesigner/designSubcontractor.除非雇主要求另有规定，否则承包商应向工程师提交每个拟定设计/设计分包商的名称、地址、详细情况和相关经验。TheContractorwarrantsthattheCon

7、ePerformanceCertificate.承包商保证承包商、承包商的设计师和设计分包商具有设计所需的经验、能力和资格。承包商承诺，设计师和设计分包商应可在任何合理的时间（在现场或场外）参加与工程师和/或雇主的讨论，直至颁发履约证书为止。PromptlyafterreceivingaNoticeunderSub-Clause8.1CommencementofWorks,theContractorshallscrutinisetheEmployersRequirements（includingdesigncriteriaandcalculations,ifany）.IftheContract

8、ordiscoversanyerror,faultorotherdefectintheEmployersRequirements,Sub-Clause1.9ErrorsintheEmployersRequirementsshallapply（unlessitisanerrorintheitemsofreferencespecifiedintheEmployersRequirements,inwhichcaseSub-Clause4.7SettingOutshallapply）.在收到第8.1条开工规定的通知后，承包商应及时审查业主的要求（包括设计标准和计算，如有）。如果承包商发现雇主要求中的任

11、yer,sRequirements,theContractor,sDocumentsshallbewritteninthelanguageforcommunicationsdefinedinSub-Clause1.4LawandLanguage.TheContractorshallprepareallContractor7sDocuments,andanyotherdocumentsnecessarytocompleteandimplementthedesignduringexecutionoftheWorksandtoinstructtheContractor7sPersonnel.TheE

12、mployerfsPersonnelshallhavetherighttoinspectthepreparationofallthesedocuments(includinganyinvestigation,modellingandtesting),wherevertheyarebeingprepared.除非雇主要求中另有规定,承包商文件应以第1.4条法律和语言中规定的通信语言书写。承包商应编制所有承包商文件，以及在工程实施期间完胡口实施设计并指导承包商人员所需的任何其他文件。雇主的人员有权检查所有这些文件的编制工作(包括任可调查、建模和测试),无论这些文件是在何处编制的。5.2.2 Rev
