4、ggoodfaith,earnestlyimplementingtherelevantprovisionsoftheRegulationonOptimizingtheBusinessEnvironment,furtherdefiningthescopeofcreditinformation,imposingpunishmentonbad-faithactsinaccordancewithlawsandregulations,improvingthecreditrepairmechanismforindividualsandentitiesinbadfaith,andpromotingthees
5、tablishmentofaIaw-国务院办公厅关于进一步完善失信约束制度构建诚信建设长效机制的指导意见(国办发(2020)49号)各省、自治区、直辖市人民政府,国务院各部委、各直属机构:为深入贯彻落实党中央、国务院关于推进诚信建设的要求,认真落实优化营商环境条例等相关规定,进一步明确信用信息范围,依法依规实施失信惩戒,完善失信主体信用修复机制,提高社会信用体系建设法治化、规范化水平,经国务院同意,现提出如下意见。一、总体要求basedandstandardizedsocialcreditsystem,withtheconsentoftheStateCouncil,theseOpinionsa

Generalrequirements以习近平新时代中国特色社会主义思想为指导,全面贯彻 落实党的十九大和十九届二中、三中、四中、五中全会精 神,坚持稳中求进工作总基调,坚持遵循法治轨道,着力 构建诚信建设长效机制,按照依法依规、保护权益、审慎 适度、清单管理的总体思路,进一步规范和健全失信行为 认定、记录、归集、共享、公开、惩戒和信用修复等机 制,推动社会信用体系迈入高质量发展的新阶段,更好发 挥社会信用体系在支撑“放管服”改革和政府职能转变、 营造公平诚信的市场环境和社会环境等方面的积极作用。UndertheguidanceofXiJ
7、inpingThoughtonSocialismwithChineseCharacteristicsforaNewEra,effortsshallbemadetocomprehensivelyimplementthespiritofthe19thCPCNationalCongressandthe2nd,3rd,4thand5thPlenarySessionsofthe19thCPCCentralCommittee,remaincommittedtothegeneralprincipleofpursuingprogresswhileensuringstability,persistentlyob
8、sen,etheruleoflaw,andfocusonbuildingalong-termmechanismforpromotinggdfaith.Mechanismsforthedetermination,recording,collection,sharing,disclosure,punishmentandcreditrepairingofbad-faithactsshallbefurtherregulatedandimprovedundertheprinciplesoft4obscrvinglawsandregulations,protectingrightsandinterests
9、,takingaprudentandappropriateapproachandimplementinglist-basedmanagement”.Thesocialcreditsystemshallbeupgradedtothenewstageofhigh-qualitydevelopment;andtheroleofthesocialcreditsysteminsupportingthereformofsimplificationofadministrativeprocedures,delegationofpowers,combinationofdecentralizationandapp
10、ropriatecontrolandoptimizationofservices“andthetransformationofgovernmentfunctionsandincreatingafair,honestmarketenvironmentandsocialenvironmentshallbebetterleveraged.在社会信用体系建设工作推进和实践探索中,要把握好以Intheprogressandpracticeofbuildingthesocialcreditsystem,thefollowingessentialprinciplesmustbeadheredto:First
11、,complyingwithapplicablelawsandregulations:Measuresinvolvingtherealinterestsofindividualsandbusinesses,suchasrecordingofbad-faithacts,determinationofthelistofseriouslydishonestindividualsandentities,andpunishmentforactsofbadfaith,amongothers,shallbeadoptedinstrictaccordancewiththelaw.Second,accurate
12、lydefiningthescope:Thescopeofcreditinformationandthelistofseriouslydishonestindividualsandentitiesshallbeaccuratelydefined;measuresforpenalizingdishonestyshallbeproperlyimplemented;andinappropriateuseormisuseofsuchmeasuresshallbeavoided.Third,ensuringthatpunishmentiscommensuratewithactsofbadfaith:Pu
13、nishmentmeasuresshallvaryintypeandseverityaccordingtothefieldsinwhichbad-faithactsoccur,aswellasthegravityandimpactofsuchacts;andthelawfulrightsandinterestsofthepartiesinvolvedshallbeeffectivelyprotected.Fourth,learningfrominternationalexperience:Thesocialcreditsystemshallbeprudentlyintroducedtofiel
14、dswherethereismuchpublicconcernaboutsocialintegrityandconsensushasyettobereachedbytakingintoconsiderationbothChinaslocalconditionsandinternationalpractices;andpropermeasuresshallbetakentoalignthesocialcreditsystemwithinternationalstandards.II. Definingthescopeandproceduresforincludingcertainactsinpu
15、bliccreditinformation1.Clearlydefiningthescopeofpubliccreditinformation:Theinformationofspecialactsinthepossessionofadministrativeorgansandorganizationswiththefunctionofadministeringpublicaffairsasauthorizedbylawsandregulations下重要原则:一是严格依法依规,失信行为记录、严重失信主体名单认定和失信惩戒等事关个人、企业等各类主体切身利益,必须严格在法治轨道内运行。二是准确界
16、定范围,准确界定信用信息和严重失信主体名单认定范围,合理把握失信惩戒措施,坚决防止不当使用甚至滥用。三是确保过惩相当,按照失信行为发生的领域、情节轻重、影响程度等,严格依法分别实施不同类型、不同力度的惩戒措施,切实保护信用主体合法权益。四是借鉴国际经验,既立足我国国情,又充分参考国际惯例,在社会关注度高、认识尚不统一的领域慎重推进信用体系建设,推动相关措施与国际接轨。二、科学界定公共信用信息纳入范围和程序(一)明确界定公共信用信息范围。将行政机关及法律、法规授权的具有管理公共事务职能的组织等(以下统称行政机关)掌握的特定行为信息纳入公共信用信息,必须严(hereinafterreferredtoasadministrativeorgans Strictly regulating the basis on which bad-faith acts aredetermined: Administrative organs must
