7、ublicofChinaonSeamenandthelawsandregulationsonoverseaslaborservicecooperationforpurposesofregulatingtheadministrationofoverseasassignmentofseamen,improvingtheoverallqualityandinternationalimageofChineseseamenassignedoverseas,safeguardingthelegitimaterightsandinterestsofseamenassignedoverseas,andprom
8、otingthehealthydevelopmentofthecauseofassigningseamenoverseas.Article 2 TheseProvisionsshallapplytotheinstitutionsengagedintheactivitiesofoverseasassignmentofseamenwhichareestablishedaccordingtolawwithintheterritoryofthePeoplesRepublicofChina.Article 3 TheMinistryofTransportshalltakechargeoftheovers
9、easassignmentofseamenthroughoutthecountry.TheMaritimeSafetyAdministrationoftheMinistryofTransport(uMOT,)shallbeuniformlyresponsibleforthesupervisionandadministrationoftheoverseasassignmentofseamenthroughoutthecountry.ThemaritimesafetyadministrationsdirectlyundertheMinistryofTransport(hereinafterrefe
10、rredtoasumaritimesafetyadministrationsdirectlyundertheMOT,)shall,accordingtotheirrespectivefunctions,beresponsibleforspecificallyconductingthesupervisionandadministrationofoverseasassignmentofseamen.Article 4 Theoverseasassignmentofseamenshallfollowtheprincipleofuwhoeverassignsseamenoverseasisrespon
11、sibleforthemH.Aninstitutionengagedinoverseasassignmentofseamenshallberesponsiblefortheseamenitassigned,anddoagoodjobinallguaranteeworkduringtheperiodwhentheseamenassignedoverseasareservingaboardandduringthecoursewhentheygoonboardanddisembark.第一章总 则第一条为规范海员外派管 理，提高我国外派海员的整体素 质和国际形象，维护外派海员的 合法权益，促进海员外
12、派事业的 健康发展，根据中华人民共和 国船员条例和对外劳务合作等 法律法规，制定本规定。第二条在中华人民共和国 境内依法设立的机构从事海员外 派活动，适用本规定。第三条交通运输部主管全 国海员外派工作。交通运输部海事局统一负责全国 海员外派的监督管理工作。交通运输部直属海事管理机构 （以下简称直属海事管理机构） 依照各自职责负责具体实施海员 外派的监督管理工作。第四条海员外派遵循“谁 派出，谁负责”的原则。从事海 员外派的机构应当对其派出的外 派海员负责，做好外派海员在船 工作期间及登、离船过程中的各 项保障工作。第二章海员外派机构资质ChapterIlQualificationsofInst
13、itutionsEngagedinOverseasAssignmentofSeamenArticle5Aninstitutionengagedinoverseasassignmentofseamenshallmeetthefollowingconditions:(1) Itmeetstherequirementsforanenterpriselegalperson.(2) Itspaid-inregisteredcapitalisnotlessthan6millionyuan.(3) Ithasthreeormoremanagementpersonnelwhoarefamiliarwithth
14、eoverseasassignmentofseamen,andinparticular,ithasatleasttwofull-timemanagementpersonnelqualifiedasshipofficersatthemanagementlevelofshipsengagedoninternationalvoyagesandonefull-timemanagementpersonnelwithtwoormoreyearsprofessionalexperiencerelatedtotheoverseasassignmentofseamen.(4) Ithasasoundintern
15、almanagementsystemandanemergencyresponseanddispositionsystem,includingthequalityofseamenservices,personnelandresources,educationandtraining,servicereports,contingencyplansforemergenciesandothercontents.(5) Itslegalrepresentativehasnointentionalcriminalrecord.Article 6 Toapplyforengaginginoverseasass
16、ignmentofseamen,aninstitutionshallsubmittherelevantcertificationmaterialssatisfyingtheprovisionsofArticle5oftheseProvisions.Article 7 AninstitutionwhichappliesforoverseasassignmentofseamenshallsubmitanapplicationtothemaritimesafetyadministrationdirectlyundertheMOTattheplacewhereitisdomiciled,andiftheplacewhereitisdomiciledhasnomaritimesafetyadministrationdirectlyundertheMOT,its
